What to Expect in your Ohio Divorce
A divorce case is initiated through the filing of a Complaint for Divorce. The Complaint is served on the other party (usually through certified mail) and that party is given 28 days to respond to the Complaint. If no response is filed, the divorce will proceed in an unconstested fashion. If a response is filed, which usually includes the filing of an Answer and Counterclaim, the case proceeds through the court system. Such proceedings involve pretrials, discovery (interrogatories, document requests, admission requests, depositions, subpoenas to third parties, psychological evaluations, custody evaluations, etc.), and trial to a judge or magistrate if necessary.
Most divorce cases are resolved prior to trial through the execution of a Separation Agreement and/or a Shared Parenting Plan (if there are minor children). If the parties are unable to agree to a resolution regarding custody they are usually sent to mediation prior to trial, which involves attempted resolution through a third party intermediary.
Dissolution and Legal Separation
Dissolutions and Legal Separations are also obtainable in Ohio.
In marriage dissolutions, the spouses agree to a Separation Agreement and Parenting Plan (if minor children are involved) prior to filing anything with the court. Thereafter, a Petition for Dissolution is filed with the court attaching the respective Separation Agreement and Parenting Plan. After the Court receives the petition a short hearing is held and the marriage is dissolved.
Dissolutions are a more amicable and cost effective approach to dissolving marriages in Ohio.
Legal Separation is an alternative to divorce or dissolution where the parties work towards a division of their property while continuing to maintain their marriage. This is a path sometimes chosen when parties wish to separate, but reconciliation is likely down the road.
