Ohio Multidistrict Litigation (MDL) Lawsuits
Class action lawsuits permit a select group of individuals to pursue claims on behalf of a defined class. There are certain requirement in order to certify a class; however, class action lawsuits are generally permitted when the number of people affected have a common interest and it is impracticable for each one of them to assert their individual interests before the court. These cases allow for judicial economy and efficiency within our already over-burdened court system.
Another benefit of class actions is that the collective damages to the class may justify litigation while ordinarily the individual damages to each class member will not. Class actions also can protect plaintiffs from inconsistent verdicts.
Another benefit of class action lawsuit is the potential remedies, which other than monetary relief, can include institutional change and other equitable relief. These remedies are generally not available in individual actions.
One of the first steps in prosecuting a class action matter is to have the class certified.
The 4 requirement for class certification are:
- Numerous class members.
- Common questions of law or fact.
- The claims must be typical of the class.
- The representative parties must adequately and fairly represent the common interests of the class.
